Terms & Conditions
General Terms and Conditions of KiBoPal, Owner Katarzyna Bracht
1. Scope of Application
(1) These General Terms and Conditions (GTC) apply to all contracts for the sale and delivery of goods concluded between KiBoPal, Owner Katarzyna Bracht, Bei den Linden 5, 21449 Radbruch, Germany (hereinafter “we” or “KiBoPal”) and our customers.
(2) Customers may be consumers (Section 13 of the German Civil Code, BGB) or businesses (Section 14 BGB).
(3) Individually agreed terms take precedence over these GTC.
(4) For businesses, these GTC also apply to future transactions of the same or a related nature.
(5) Deviating or additional terms of the customer only become part of the contract if we have expressly agreed to them in writing.
2. Conclusion of Contract
(1) The presentation of our goods, in particular in the online shop, does not constitute a legally binding offer but a non-binding invitation to the customer to submit an offer.
(2) The customer submits a binding offer to conclude a purchase contract by completing the ordering process in our shop and clicking the “Buy” button at the end. The customer can correct their entries at any time before submitting the order.
(3) After receipt of the order, the customer receives an automatic confirmation of receipt by email. This does not yet constitute acceptance of the offer.
(4) The contract is concluded by our express declaration of acceptance (e.g. by email) or by delivery of the goods within two (2) working days of the order.
(5) We reserve the right to refuse orders, in particular in the event of late payment, doubtful creditworthiness or obvious errors.
3. Delivery and Shipping Conditions
(1) Delivery is made within the European Union and to Switzerland.
(2) The delivery time for freight goods is usually 3–14 working days from receipt of payment, unless otherwise stated in the respective product description.
(3) Pallets and pallet boxes are usually shipped by freight forwarder. We mainly work with Cargoboard but reserve the right to use other freight forwarders.
(4) The customer is usually notified by the freight forwarder before delivery (to arrange a delivery date). Unless otherwise agreed, deliveries are made to the unloading point selected and paid for by the customer (e.g. curbside, yard, loading ramp).
(5) Self-collection at our location in 21449 Radbruch, Germany, is possible by prior arrangement.
(6) We are entitled to make partial deliveries insofar as this is reasonable for the customer. The customer will not incur any additional shipping costs as a result.
(7) For consumers, the risk of accidental loss and accidental deterioration of the goods passes upon handover of the goods to the consumer or a third party designated by the consumer. For businesses, the risk passes upon handover of the goods to the freight forwarder, carrier or other person designated to carry out the shipment.
4. Prices, Shipping Costs and Minimum Order Quantities
(1) All prices are quoted in euros as final prices including the applicable statutory German value-added tax.
(2) Shipping costs are calculated individually based on weight, volume, pallet spaces and the postal code of the delivery location, and are displayed to the customer before the order is placed or stated in the quotation.
(3) For deliveries to non-EU countries (e.g. Switzerland), additional customs duties, taxes and fees may apply, which are to be borne by the customer.
(4) For the shipment of pallets, the following applies: the minimum order quantity for delivery is 10 units (equivalent to 1 pallet space). Self-collection is possible from as little as 1 unit.
5. Payment Terms
(1) The following payment methods are generally available:
- Prepayment by bank transfer
- PayPal
- Google Pay
- Klarna (depending on the options available in the shop, e.g. Sofort, invoice, installments)
- Cash payment on collection
(2) For prepayment, the invoice amount is due within 10 days of conclusion of the contract. The goods are shipped only after receipt of payment.
(3) For cash payment on collection, the purchase price is due in cash upon handover of the goods.
(4) The terms of the payment service providers displayed during the ordering process (e.g. PayPal, Klarna) apply.
6. Retention of Title
(1) The delivered goods remain our property until the purchase price has been paid in full.
(2) For businesses, the extended and expanded retention of title also applies:
- The customer is entitled to resell the reserved goods in the ordinary course of business. The customer hereby assigns to us in advance all claims in the amount of the invoice total that accrue to them from the resale against third parties.
- We hereby accept this assignment. The business remains authorized to collect the claims as long as it meets its payment obligations.
- Pledging or transferring the reserved goods by way of security is not permitted.
- The business must notify us immediately of any third-party access to the reserved goods (e.g. seizures).
7. Warranty (Liability for Defects)
(1) The statutory warranty rights apply unless otherwise provided below.
(2) For consumers, the warranty period for new goods is two (2) years from delivery. For used goods, the warranty period is one (1) year from delivery. This reduction does not apply to claims for damages arising from injury to life, body or health, in cases of gross negligence or intent, or in cases of fraudulent concealment of a defect.
(3) For businesses, the warranty period is one (1) year from the transfer of risk.
(4) Businesses must inspect the goods immediately after delivery and report any identifiable defects without delay, at the latest within seven (7) days; otherwise the goods are deemed to have been approved (Section 377 of the German Commercial Code, HGB).
(5) If the delivered goods are defective, the customer may demand subsequent performance. If the customer is a business, we are entitled to choose the type of subsequent performance (repair or replacement delivery).
(6) If subsequent performance fails or is unreasonable for the customer, the customer may reduce the purchase price or – in the case of a defect that is not merely insignificant – withdraw from the contract.
8. Liability
(1) We are liable without limitation:
- for intent and gross negligence,
- for damages arising from injury to life, body or health,
- under the provisions of the German Product Liability Act
(2) In the event of a slightly negligent breach of essential contractual obligations (cardinal obligations), our liability is limited to the foreseeable damage typical of the contract. Cardinal obligations are obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the customer may regularly rely.
(3) There is no further liability. The above limitations of liability also apply in favour of our legal representatives and vicarious agents.
9. Right of Withdrawal for Consumers
(1) Consumers have a statutory right of withdrawal for contracts concluded off-premises and for distance contracts.
(2) The details are set out in the following withdrawal notice.
Withdrawal Notice
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform us
KiBoPal
Owner: Katarzyna Bracht
Bei den Linden 5
21449 Radbruch
Email: info@kibopal.de
by means of a clear declaration (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but this is not mandatory.
Consequences of withdrawal
If you withdraw from this contract, we shall reimburse all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received notification of your withdrawal from this contract.
For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement.
We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us without undue delay and in any case no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you dispatch the goods before the fourteen-day period expires.
You bear the direct costs of returning the goods. For freight goods, return costs may be considerable depending on volume and weight.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Exclusion or premature expiry of the right of withdrawal
The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and whose manufacture is determined by an individual choice or specification by the consumer, or which are clearly tailored to the personal needs of the consumer (custom-made products).
10. Model Withdrawal Form
If you wish to withdraw from the contract, please use the separate model withdrawal form or send us your withdrawal in a clear form (e.g. by email).
11. Information on Online Dispute Resolution and Consumer Arbitration
(1) The European Commission provides a platform for online dispute resolution (ODR), which you can find at
(2) We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
12. Final Provisions, Choice of Law, Place of Jurisdiction
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which they have their habitual residence.
(2) If the customer is a business, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and us is our place of business in Radbruch, Germany. However, we are also entitled to sue the customer at their general place of jurisdiction.
(3) Should any provision of these GTC be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
